Clark County Council

September 15, 2026 · 04:40:00 matched · Watch on CVTV ↗

The Clark County Council began its meeting by inviting public comments on the consent agenda and separate business items, clarifying that specific topics would receive dedicated hearings later in the proceedings. The council subsequently granted unanimous approval to all seven items on the consent agenda without further debate. Additionally, officials authorized an amended interlocal agreement with the state, which repurposes existing budget funds for HVAC and building automation upgrades at three county facilities to meet 2027 energy efficiency targets. During later public hearings regarding capital facility plans for local fire districts and an extension of the annual comprehensive plan review suspension, citizens urged the council to reduce overall spending and prioritize funding for frontline firefighters over administrative expenses. Attendees also voiced frustration over the late hour of the meeting but expressed support for extending the comprehensive plan review suspension to temporarily give the government a "rest."

Background (continued)
Main drivers of General Fund support
* Sporadic updates to fees in past years
    * Prior to the 2024 update, which set fees to cover the cost of
providing the services, the Land Use Review and Wetland and
Habitat Review programs had not seen meaningful updates to fees
    in nearly 15 years
    * Cost of providing services increases each year, but fees did not
cover those costs, resulting in the need for General Fund support
* Intentional subsidization of program costs by previous councils
    * General Fund support for fee work, also known as "public share"
    * Allocation of General Fund dollars for non-fee supported activities
        * Customer service to applicants - 'planner of the day',
        extra assistance to one-time applicants
        * Clark Conservation District - works with land owners to
maintain exempt status and avoid violations

Capital Facilities Plan 2026-2032
Criterion B:
The planning commission shall review a school district's capital facilities plan or plan update in
accordance with the provisions of CCC 40.620.030(B). The code specifies that the planning
commission shall consider:
* Whether the district's forecasting system for enrollment projections appears reasonable and
reliable;
* Whether the anticipated level of state and voter-approved funding appears reasonable and
historically reliable; and
* Whether the standard of service set by the district is reasonably consistent with standards
set by other school districts in communities of similar socioeconomic profile; and
* Whether the district appropriately applied the formula set out in CCC 40.620.040.
Summary of Findings:
* District enrollment projections, state and voter-approved funding appear reasonable and
reliable
* Standard of service consistent with other Clark Co. school districts
* Exhibit B, p. 13-14 outlines why CFP does not propose new impact fees. Application of the
impact fee formula in CCC 40.620.040 is not applicable to proposal
Conclusion: Proposal meets criterion B

Specific Questions
1. What is the basis for a change in the impact fee?
District Current (SF/MF) Proposed (SF/MF) Changes between current plan and proposed plan
Hockinson $7,790/$3,434 $15,174.54/$1,720.12 Significant increase in cost of new elementary school and larger school planned for (from 350 to 500 students).
La Center $3,501/$3,104 $7,536.00/$3,045.74* In prior plan, the cost of new facilities needed for growth was roughly $16,000,000. For the current plan, it is $33,000,000.
Woodland $5900/$5900 $10,545.93/$13,664.57 Addition of new elementary school in current plan is primarily needed to serve growth (prior plan had new high school but only a small portion of it was needed for growth so the cost input was much smaller).
* Please see Attachment A, which is the resolution adopted by the La Center School District School Board setting the fee for single-family dwellings at less than the maximum amount after receipt of stakeholder input.
2. What is basis for enrollment forecast; how closely has actual enrollment tracked those projections, and do more recent enrollment figures affect the projected facility need or the impact fee calculation?

BACKGROUND
Background:
Staff requests that the Council extend the existing suspension of the annual review plan amendment cycle for 30 additional days, to expire on October 30, 2026.
On September 6, 2022, the Council held a public hearing and approved Resolution No. 2022-09-03. The purpose of that resolution was to suspend the annual comprehensive plan amendment cycle as set forth in CCC 40.560.010 from October 1, 2023, through September 30, 2025. The suspension was to allow the county to complete the comprehensive plan 2025 periodic update consistent with RCW 36.70A.130(2)(a), "whereby updates, proposed amendments, or revisions of the comprehensive plan are considered by the governing body of the county or city no more frequently than once every year." At that time, the periodic update was expected to be complete by June 30, 2025.
After the adoption of Res. No. 2022-09-03, the timeline for adoption of the 2025 periodic comprehensive plan update was extended by approximately one year. That resulted in the adoption of Res. No. 2025-09-01 which extended the suspension of the annual plan amendment cycle through September 30, 2026. Because the 2025 periodic update is now expected to be approved in mid-October 2026, an extension of the suspension of the annual plan amendment cycle through October 30, 2026, will maintain consistency with
November 1, 2026, to be adopted no sooner than one year after adoption of the comprehensive plan

The council chair opened the meeting's general public comment period, inviting attendees to speak on consent agenda and separate business items. The chair clarified that specific agenda items would have their own dedicated public hearings later, before calling the first registered speaker to the podium.

The council opened public comment and hearing periods for several agenda items, including capital facility plans for local fire districts and an extension of the annual comprehensive plan review suspension. While some items received no public input, participating citizens urged the council to prioritize funding for frontline firefighters over administrative costs and to reduce overall government spending. Public testimony also included support for extending the annual review suspension to give the government a "rest" and expressed frustration over the late hours of the meeting.

cross_cutting 4:26:30–4:28:01 · 2 match(es)

The council unanimously approved items one through seven on the consent agenda without pulling any items for further discussion. Following this, the Director of Internal Services requested authorization for the county manager to sign an amendment to an interlocal agreement with the state regarding clean building projects. This agreement, along with the repurposing of existing budget funds, supports necessary HVAC and building automation upgrades at three county facilities to meet state energy efficiency targets by 2027.

7:42 in 2021 star's life was violently taken in an act of unimaginable domestic violence when she was stabbed to death by her husband in front of their son the attack lasted only moments but the devastation has lasted years for her son who must grow up without his mother for her family who will never again hear her walk through the door for her friends who still reach for the phone sometimes forgetting for just a second that she's gone national homicide victims month exists because victims are more than headlines court files case numbers star is not a case number she mattered her life mattered her voice mattered and even now years later since 2021 an ongoing court proceedings continue to reopen the wounds for people who loved her most

8:36 while we continue to navigate grief we remain committed to making sure her voice and the voices of homicide victims everywhere are never forgotten and never minimized and never lost tonight i ask that you remember star not for the violence that she took that took her life but for the beautiful life that she lived i would like to conclude by sharing a short recording of star's voice so that you can hear a small piece of that incredible person we were so fortunate to love

4:20:04 nay councillor fuentes councillor little aye chair marshall aye thank you motion carries four to one three to two oh I'm sorry three to two it's late okay uh I believe that concludes the capital facilities plans for the what three districts four districts okay thank you very much appreciate all the work that you do I know it was a great deal of work to bring this forward so good work thank you thank you chair thank you council I'll just stay up here good okay we're going to be moving on to the annual review suspension extension and bart uh we've been this through this I think at least a couple of times but if you could remind

4:21:01 us what this is about yeah this is I think my third time and jose did it uh before that um so this is probably your easiest one of the evening uh we have a suspension of the uh annual review process in effect uh that was started back in uh 23 as noted in the staff report and um statutorial statutorily we cannot um open up the comp plan more than once a year the uh periodic update is that opening in this year so uh we thought we'd get done a little earlier but as we all know we are finishing up in a couple weeks and therefore our uh extension of the um suspension that was going to end uh september 30th was a little short and so 30 more days should get us uh to the finish line

4:21:59 and then we can open up the annual reviews for next year's cycle which we will expedite as quickly as possible we know we have lots of people in the queue that want to get in on it as soon as the comp plan is done so that's all I have to say about that unless anyone has any questions I have a quick question yes and when would it does it open up immediately after the comp plan is adopted or would it begin with the new year the the applications normally would open at the beginning of october but since we can't do that legally then we if you all approve this then we will send out a news release and open them up on november 1st so we'll lose 30 days but we should be able to get back on track and then be looking at them in the early part of next year well we've lost 10 months so well there you go who's counting I know some people

4:22:56 who are okay um any questions on this one okay this is a subject go ahead does this need a public comment public hearing yes yeah okay anybody uh online we have a hand raised chair okay thank you caller you've been sent a request to unmute please go ahead and do so state your name for the record and go ahead with your comment hi Kimberly Goheen Elbin so um I just got home and I actually left my papers um here at home uh my printed agenda that had some errors on it and things but with that said um on one of the sheets it did not have this as a public hearing so um I did read over it um just bear with me here for a moment I don't want to go in the house because I got

4:23:56 three puppies that'll maul me to death so um I say if this affects the gma or anything else or maybe a small shutdown of our of our government to settle things down and spending and stuff I say let's do let's just uh uh suspend it forever that's what I would like to think but uh of course that'd be silly to think something like that right um I I don't know if it's responsibilities that this has to be extended and all that. And there's, um, you know, a lot, this is a deep subject, uh, some call it a swamp, but, um, yeah, I, I go ahead. You're going to do it anyway, because I'm only one speak person speaking about this, which I really wish I wasn't,

4:24:49 but, um, do whatever it is that the people, the majority of the people want. And pretty much the few that show up, I can tell what that majority want. And they represent thousands of people, not just, I used to say hundreds, but now it's thousands of people, but they're too busy there. I mean, look at it. It's what, uh, 1027 at night. This might be by design that it's late like that. And nobody, you know, everybody's in bed getting ready for work tomorrow morning. Right. Get their good sleep or the breathing in all this toxic nano product. So, um, yeah, let's get, let's just rest the government a little bit. How about that? And think about that. Go to bed tonight and pray to God. Bye-bye. Bye. Okay. That concludes public comment. Uh, any further comments, uh, from the council and if not, I'll entertain a motion. Well, I'll entertain.

4:25:49 A motion to approve. So moved. Matt little. It's been moved. Is there a second? Second counselor, young seconded. Okay. Oh, this is a resolution. I was all set for a roll call. Okay. Uh, all those in favor say aye. Aye. Aye. Opposed though. Okay. Unanimous. Thank you. Thank you. Okay. Then moving on. There's yeah. Yeah. But there's, there's more that we have to deal with here. Uh, the consent agenda. Uh, would anyone like to pull anything on the consent agenda? No. Okay. Then I'll entertain a motion to approve the consent agenda item one through seven. So

4:26:46 moved. It's been moved. Is there a second second point? Moved and seconded. It was counselor young who moved it and counselor Fuentes who seconded all those in favor say aye. Aye. Aye. Motion carries. Okay. Separate business item. Uh, number one, uh, internal services, Michelle, you're here to chat with us about this. Thank you for sticking around for this long night. No problem. Uh, good evening counselors, Michelle Schuster, director of internal services. Um, I'm here tonight to request approval to repurpose budget between three of our clean building projects and approve and approve. For the county manager to have authority to sign this amendment to the interlocal agreement with DS that's been previously approved. And all future amendments for these projects, the public service center, the center for

4:27:45 community health and the courthouse need to meet a specific state target effective use life, our EUL by 2027 CCH. We have found currently is actually meeting the targeted EUL due to, um, being part of the strategic energy management cohort that we've been in since 2019 with Clark public utility. We've had no cost, low cost projects on the building. We've done some other upgrades. When we moved the VA in, there was some requirements to bring some lead standards into the building. So because of all those efforts we've done over the years, we've actually found out that we've met the target, um, that we didn't think we're going to be able to hit. And so, um, our PSC billion, unfortunately, is still not meeting our extended use EUL. Um, and then our courthouse is barely meeting it right now. Um, and the equipment. Okay. The HVAC system is really at end of life. And so we're afraid that if we don't replace that,

4:28:42 even though it's mean the EUL right now, it may not meet it because we've got to continuously measure this. And so if something should fail, we wouldn't be meeting it. So what we're asking tonight is that, um, we take the money that was set aside for CCH and we repurpose it because the PSC is coming in a little bit higher than what our initial budget figure was. And then our courthouse is coming in quite a bit higher. Okay. And so, but taking the savings from CCH and reallocating them to those two projects, plus the, um, early adopter incentive, we're going to get for PSC and some utility credits that we're going to get from doing these projects that will actually cover both the courthouse and the PSC work we need. So we don't need any additional funding, but we do need to repurpose funding that's already been approved. Um, and for the PSC, um, the big things that are going to happen is we're going to do the,

4:29:37 uh, replacement of the JACE controllers, which are really the brains of our HVAC. And we're going to integrate that into our building automation system, and that'll help run our air handlers more efficiently, our terminal units, our fan cooling units, our exhaust fans, our boiler and heating water systems, our boosters and fire pumps, our chiller cooler towers. We're also going to be installing some CO2 sensors throughout the building. And so that'll really help us like tell where people are and where we need to be. Um, and then we're going to be looking at, you know, what's going to happen when we need to basically put more HVAC into those areas and less in areas that aren't as fully populated in the building. Um, it'll add some alarms, uh, monitor the outside air to help with the conditioning and then sequence and provide efficiency. So that's sort of the work that'll be going to the PSC with this clean building money. And then for our center for, or for our courthouse, um, we'll be replacing all of the controller units over there. Um, the existing

4:30:36 controller units are, um, from 2002, they've reached end of life. They're not very efficient. Um, and so this will basically, and then we're going to be replacing a lot of our pneumatic actuators that are over there that are really past end of life. Um, and this will really help control our operations, the ease of troubleshooting over there, more control over the system and really comfort level in the courthouse. Cause I don't know if you've been in the courthouse, but they have a lot of fans in the courtroom. Um, and so we're going to be replacing a lot of our actuators to move air because our system isn't as effective as it could be. And so it'll really improve that. And we have talked to the courts. We're going to do a lot of court activity outside normal hours, cause we can't interrupt courts. So a lot of this work will be happening after hours weekends for that PSC. We'll see some work during the normal business operations, but not stuff that's going to disturb the really disturbing stuff. Stuff that might disturb operations will be after hours, but to keep the price down, we're going to try and fit some of that into the normal,

4:31:36 Monday through Friday. So that's the ask tonight is to repurpose some funds to get the two buildings up to compliance for the deadline in 2027 and to get the contract signed with DES. Great. Thank you very much. And thanks for juggling all these complex things with all of these buildings. Are there any questions from council? Chair? Yes. Pneumatic actuators. That's very interesting. And I'm curious, but I'm not going to ask any questions. I move approval of separate business item number two. Thank you. This is separate business item number one. Sorry, number one. Yep. I second. Moved and seconded. Any other comments? If not, all those in favor say aye. Aye. Motion carries. Okay. Item number two. Thank you, Michelle. Public works.

4:32:32 I think Marlena Milosevic-Butler. Is that who it is? Well, this is for request approval to submit four grant proposals to Washington State Department of Ecology to fund stormwater capital projects. I think we've all had a chance to look those over. So moved. I think we finally hooked -- I think I'm finally hooked in. Is that Jeff? Can you hear me? Hi, Jeff. I think we're getting a little echo. How's that? That's great. All right. Sorry about the technical difficulties. Good evening, Chair. Good evening, council. Jeff Schnabel, infrastructure and assessment.

4:33:32 I'm Jeff Schnabel, infrastructure and assessment services manager with clean water division. Standing in for Marlena Milosevic-Butler tonight who is our capital program manager. This item, separate business number two for you tonight is a request to approve submittal of four grant submittals or proposals to Washington Department of Ecology for some of our stormwater capital projects from the six-year plan. Most of you are familiar with this. We tend to come back about this time each year looking for approval to submit grant proposals. This year we have four projects listed in front of you there that basically they all go to the water quality combined funding program. So there's a number of different grants that are covered in one sort of application. The two that we get most of our funding from Ecology from are the stormwater financial assistance program, the stormwater financial assistance program.

4:34:28 The two that we get most of our funding from Ecology from are the stormwater financial assistance program, which is called SFAP and then also the centennial clean water fund for projects that are more non-point source pollution, things like stream restorations, reforestation projects where the SFAP dollars go towards infrastructure improvement, things like stormwater facility retrofits and brand new facilities that we construct. The two that we get most of our funding from Ecology from are the stormwater financial assistance program, the stormwater financial assistance program, which is called SFAP and then also the centennial clean water fund for projects that are more non-point source pollution, things like stream restorations, reforestation projects where the SFAP dollars go towards infrastructure improvement, things like stormwater facility retrofits and brand new facilities that we construct. 4:35:23 reforestation, sorry. And those last three, two, three, and four are for the centennial fund dollars. So total of all of these is just about exactly $2 million that we'll be requesting. And we're just looking for your approval to go ahead and send in those applications. And if you have any questions, I'll certainly try to address them. Great. We love to hear about grants submittals. Would any of these be in jeopardy related to us being out of compliance with the GMA? Yeah, good question, Chair. So the only one of these four that would be in jeopardy is the first one. So projects that are funded with the Stormwater Financial Assistance Program are susceptible to that. We do have to be in compliance with GMA to be able to accept those dollars. So that one's for $765,000.

4:36:18 So that would be at risk if we were not in compliance with GMA at the time that we needed to sign a grant agreement, which is a little while from now, a year or so. But the other three, the centennial fund source is not subject to those restrictions. So those three are safe regardless of GMA compliance. Great. Thanks for that information. Any questions or comments from the council? If not, I'll entertain a motion to approve. So moved. Matt Little. I think we don't have a court reporter anymore. So you're good. So it's been moved and seconded. All those in favor, say aye. Aye. Motion carries. Thank you very much. Jeff. Thanks, Council. Yep. And now temporary road closure, which has been added to our agenda item three of bridge number 222.

4:37:18 This is a staff report and a resolution to, it's a formality we had on September 5th. Just for the record, could you identify yourself? Yes. Steve Gallup, Transportation Division Manager within Public Works. Last name is G-A-L-L-U-P. And on September 5th, we had a crash. That vehicle crashed into one of our bridges and guardrail approaching the bridge. And because of that, we actually had to close the road down on Northeast 167th Avenue over there in the Hawkinson area. And so until we could get our bridge engineer out there to inspect the bridge and make sure it was safe to reopen.

4:38:18 So once our bridge engineer did that, we reopened it. But per the RCW, we have to give you guys permission, approval to close the road that we already did. Okay. We want to follow all the rules. Any questions? I'm sorry. I have one. Okay. Go ahead. Are we going to be working on collecting damages? Yes. We are paying for the repairs? So we do. Yeah. If they have insurance that we can collect on, we get that information at the time of crash and go after the insurance for recovery costs. Okay. If there's no other questions, I'll entertain a motion to approve. So moved. Second. Moved by Belcott, seconded by Young. All those in favor say aye. Aye.

4:39:18 Councilor Little I didn't hear your I. Yeah I said I. Okay thank you. Just making sure. Okay. Thank you. Unanimous all those in favor. Well I'm not I already said that. Okay motion carries. County managers report. I have nothing. Thank you. Great. Thank you. We've completed our agenda and without objection this meeting is adjourned.
