Clark County Land Use Hearings · Sep 10, 2026 · 3:04–6:59 · Watch on CVTV ↗

The Clark County Land Use Hearings Examiner outlined the procedures for a public hearing reviewing five proposed subdivision developments. He explained the rules for public testimony, noting that applicants have 20 minutes to present their projects while individual public comments are limited to three minutes. Furthermore, the examiner emphasized that his decisions are strictly driven by the county's Unified Development Code, requiring all public feedback to address specific approval criteria rather than general complaints.

2:02 those standards and makes a recommendation as to whether in staff's view the application meets or doesn't meet the approval criteria. That's my ultimate job, is to make that decision as to whether, in fact, they do meet those criteria. In convening this proceeding and making that decision, I'm required to be objective and impartial. And I believe that I am with all five of these items. I don't have any business or personal or familial relations with any of the applicants or any of the parties that have weighed in on each of these items. What I know about each of these cases is what I have gleaned from the record. I've had my record for about two weeks now on each of these. And as I mentioned, I don't have any particular biases either. So if anyone has any questions or wishes,

2:56 to challenge or question me about any of my potential conflicts of interest or ex parte contacts, feel free to do so during the public testimony portion of tonight's hearing. With regard to each of these items, though, here's the process that we're going to follow. We'll take them in order in which they appear on the agenda. Let me run through them quickly. First is Cressup Meadows Subdivision. That's PLD 2022. That's PLD 2026-52. And then is 39th Avenue Subdivision, PLD 2025-94. Then Heartwood North Subdivision. That's PLD 2025-114. The fourth one is Ardennell Estates Cluster Subdivision, PLD 2025-8. And finally, Pleasantwood North Subdivision, PLD 2026-21.

3:55 So we'll take those in the order in which they appear. We'll begin with a staff report, which is a verbal rendition of the written staff report that was issued prior to tonight's hearing on each of these items. After the staff report, I'll take the applicant's presentation. The applicant, you can assume I'm generally familiar with the proposal, but there are a couple of things I really want to know kind of upfront from you about it. About the project. First of all, what is the current version of the plan before us tonight? So I, and everyone else that's zooming in on this, knows what is the latest version of the proposal. Second, I need to know your, if you have any corrections or objections or changes you would like to see in the staff report, either in the findings or the staff's

4:55 recommended conditions of approval. Give me those with specificity so that I and staff and everyone else can understand exactly what changes you want to see to the staff report. And finally, in all of these, I want the applicant to keep track of the testimony that comes in and to be prepared during your rebuttal to respond to the testimony that is presented by public. And I say that because a lot of times the testimony that I get from the general public comes in the form of questions about or assumptions about how this project is going to work, how it's going to impact the neighborhood, how it's going to impact neighbors, how the stormwater system works or doesn't work. Those sorts of questions are often best addressed by the applicant's team. So be prepared to respond to those things during your final rebuttal.

5:55 So, after the applicant's presentation, I'll take testimony from anyone else in favor of the proposal. After that, I'll take testimony from anyone with neutral testimony or questions. And finally, I'll take testimony in opposition to the proposal. After that, I will take the, the applicant gets final rebuttal. In all of these cases, the applicant gets the last word because the applicant has the burden of proof. That is the burden of proving that they have. They have met all of those approval criteria that I mentioned and are addressed in the staff report. So after the applicant does their final rebuttal, I turn to staff to see if they have any additional comments they would like to share based on the public testimony that's come in. And it's my typical habit then to close the record unless someone has requested a continuance or that the record be kept open. I think in all of these though,

6:54 I think in all of these other cases, I've had the record be kept open at least one week for each of these items. So that puts us out at least a week before the record closes. And that's important because for anyone who wants to get anything into the record before me, for me to consider, that ends your chance to raise new issues or to present evidence. Also that ends your chance to make your record for a potential appeal. My decisions are the final decision at the county level. They are appealable when they come out to Clark County Superior Court through the Land Use Petition Act. But to bring a LUPA appeal, you have to participate either orally or in writing before the record closes. And you have to raise before me any issue that you want to preserve for that appeal. And you also need to present to me any evidence or documents or memos or anything that you want to rely upon in a subsequent appeal.

7:54 So it's important for all of you to understand when the record closes on each of these items.
